Electronic Interaction and Simple Electronic Signature Agreement

This Agreement defines the procedure for electronic interaction between the User and Self-employed Kulakov Kirill Dmitrievich (TIN 710406098539) (the Operator), when using the Diarynchy service (app.diarynchy.com), and the procedure for using a simple electronic signature (SES). This Agreement is accepted by the User after confirming the email address with a one-time code and before signing consents and acceptances in the Service interface.

1. Simple electronic signature

The parties agree that checking a box in the Service interface after confirming the email address with a one-time code sent to the address provided at registration constitutes a simple electronic signature within the meaning of Article 5 of Federal Law No. 63-FZ "On Electronic Signature" and is recognized as equivalent to a handwritten signature based on agreement of the parties (Article 9 of said law).

The simple electronic signature is used to express consents to personal data processing, consent to processing special categories of personal data, consent to automated processing using AI, acceptance of Terms of Use, acknowledgment of entry content limitations, acceptance of this Agreement, and other marks provided for in the Service interface.

2. Email address confirmation

Before making legally significant marks, the User confirms the email address with a one-time code sent to the address provided at registration.

The one-time email confirmation code is valid for 15 (fifteen) minutes from sending and may be used once. A new code may be sent after the previous one expires.

The Operator does not store one-time codes in plain text. The fact of successful email confirmation and the identifier of the corresponding event are recorded.

3. Recording legally significant events

For each consent, acceptance, or withdrawal, the Operator records:

  • user identifier (user_id);
  • email address (email);
  • email confirmation date and time (email_verified_at);
  • event type (event_type) and document type (document_type);
  • document version (document_version / policy_version);
  • hash of the canonical document text at acceptance (document_hash / consent_text_hash, SHA-256);
  • acceptance date and time (accepted_at, UTC) and withdrawal (revoked_at, if any);
  • IP address (ip_address);
  • user-agent string;
  • interface language (locale);
  • signature method (signature_method);
  • session identifier (session_id), if available.

The retention period for such records is defined in the Data Retention and Deletion Policy.

4. User identification

To minimize personal data, the Operator does not collect users' passport data. User identification within electronic interaction is performed through confirmed email, one-time code, and simple electronic signature in accordance with this Agreement.

5. Consent withdrawal

Consent may be withdrawn as specified in the relevant documents at https://diarynchy.com or through app settings.
