1. Acceptance of terms

By using the Diarynchy service (the "Service"), you agree to comply with these Terms of Use (the "Terms"). The Service is provided by Самозанятый Кулаков Кирилл Дмитриевич (the "Provider"). Payment for paid access is governed by the public offer. If you do not agree with any provision of the Terms, please do not use the Service.

We reserve the right to change the Terms at any time. The current version is always available on this page.

2. Description of the Service

Diarynchy is an online diary with artificial intelligence features that helps users keep entries, analyze emotions, and track their emotional state.

Important: The Service is not a substitute for professional psychological or medical care. If you are experiencing serious emotional difficulties, please consult a qualified specialist.

3. Registration and account

The Service is intended exclusively for individuals aged 18 or older. By registering, the User confirms they have reached this age.

To use the Service, you must create an account. You agree to:

  • provide accurate information when registering;
  • keep your account information up to date;
  • maintain the confidentiality of your password;
  • notify us immediately of any unauthorized use of your account;
  • give consent to personal data processing, accept the Terms of Use, and confirm acknowledgment of entry content restrictions — in the app registration interface;
  • before access to free-form diary entry, the User signs separate consent to processing special categories of personal data that they may voluntarily include in diary entries. The Service does not require such information and is not specifically designed to collect it;
  • Without such consent, the User may use only those Service features that do not involve free-form diary entry.
  • consent to automated processing using AI is optional and given via a separate checkbox;

4. Rules of use

When using the Service, you must not:

  • violate applicable law;
  • publish illegal, offensive, or harmful content;
  • attempt to gain unauthorized access to the Service systems;
  • use automated means to access the Service;
  • share access to your account with third parties.

5. Restrictions on entry content

The Service is not intended to store medical documentation, medical records, examination results, doctor prescriptions, or other medically prescribed documents. The Service accepts that the User may voluntarily describe personal circumstances, experiences, and life situations. The Service does not require special categories of personal data and is not specifically designed to collect them. If the User includes such information in diary entries, it is processed on the basis of separate consent. In some cases, the User may independently include in an entry information relating to health, intimate life, religious views, or other special categories of personal data provided for by Article 10 of Federal Law No. 152-FZ. The Service does not require such information and is not specifically designed to collect it.

Do not place in the Service information not needed for a personal diary: passport data, TIN, SNILS, bank details, card numbers, passwords, access codes, API keys, third-party data without their consent, full medical documents, and examination results.

You are responsible for complying with these restrictions. Details are in the Privacy Policy.

The Operator may block or delete information that objectively should not be stored in the Service: bank cards, passwords, access keys, passport data, third-party data without their consent, unlawful content, and other clearly dangerous information.

6. Intellectual property

All rights to the Service, including design, logos, text, and software code, belong to the Provider or its licensors.

The content of your diary entries remains your property. You grant us a limited license to process that content solely to provide the Service.

7. Beta testing

The Service may operate in test mode during the beta testing period. Features may be unstable, change, or become temporarily unavailable without prior notice. By using the Service during this period, you understand and accept these limitations.

How diary entries and AI features are handled is described in the Privacy Policy and AI Policy.

We value feedback and use it to improve the Service.

8. Data storage and protection

All user data is initially stored and processed in the Russian Federation. Diary entries and account data are stored on the Provider's own technical means in the Russian Federation. Data is transmitted over a secure connection (TLS) and stored with encryption at rest.

The team does not review entries in bulk. Access to individual texts is possible only in limited cases: fixing failures, investigating security incidents, or handling a support request — only to the extent necessary.

9. Simple electronic signature

The procedure for using simple electronic signature and electronic interaction is defined in a separate Electronic Interaction and Simple Electronic Signature Agreement, which the User accepts after confirming their e-mail address and before signing consents in the Service interface.

Consent may be withdrawn by the methods specified in the relevant documents at https://diarynchy.com or through app settings.

10. Data processing in the Russian Federation

Data processing is carried out in the Russian Federation.

Analysis of user entries is performed using language models hosted on Yandex.Cloud LLC infrastructure (Yandex AI Studio service) and on the Operator's infrastructure in the Russian Federation.

Personal data of users is not transferred to foreign organizations.

Analysis uses the minimum necessary amount of data; only the fragment of an entry required for the requested feature is transferred.

The Service does not use users' personal data to train its own artificial intelligence models.

Analysis is performed automatically without making legally significant decisions regarding the user.

Using intelligent analysis features requires separate optional consent to automated personal data processing using artificial intelligence technologies. Without such consent, electronic diary mode without AI is available. The consent text is published on the Personal Data Consent page and in the registration interface.

The User may use the Service solely as an electronic diary without intelligent analysis features. AI features can be disabled in app settings.

11. AI use and emergency situations

11.1 Use of artificial intelligence

Responses, recommendations, analytics, conclusions, and other results of AI features are generated automatically based on machine learning algorithms. Results may contain errors, inaccuracies, incomplete or outdated information.

Analysis is performed automatically without making legally significant decisions regarding the user.

Service results are not:

  • a medical conclusion;
  • psychological counseling;
  • psychotherapy;
  • legal advice;
  • financial advice.

The User independently makes decisions based on the information received.

11.2 Emergency situations

The Service does not monitor user entries in real time. The Provider does not guarantee detection of crisis states or threats of harm to oneself or others. The Service is not intended for emergency psychological assistance. If there is a threat to life or health, or urgent help is needed, the User must contact emergency services or qualified specialists.

12. Limitation of liability

The Service is provided "as is". We do not guarantee:

  • uninterrupted operation of the Service;
  • absence of errors or inaccuracies;
  • that the Service will meet your expectations.

We are not liable for any indirect, incidental, or punitive damages related to use of the Service.

13. Termination of access

The Provider may temporarily restrict or terminate access to the Service if:

  • applicable law is violated;
  • these Terms are violated;
  • there is a threat to Service security;
  • fraudulent activity is detected;
  • technical failures need to be remedied.

You may delete your account at any time through profile settings.
